इंडेम्निटी नोट और RR के बिना डिलीवरी (Indemnity Bonds / Delivery in Absence of RR)

1. Section 77 के अनुसार नियम

1. यदि Railway Receipt (RR) उपलब्ध नहीं है, तो Indemnity Note पर माल की डिलीवरी दी जा सकती है।

2. यदि एक से अधिक व्यक्ति किसी खेप के हकदार हों, तो डिलीवरी रोक दी जाएगी और केवल वही व्यक्ति माल प्राप्त कर सकता है, जो Indemnity Note भरता है।

2. Indemnity Note – परिचय

• यह एक कानूनी दस्तावेज है, जिस पर Stamp Duty लागू होती है (राज्य अनुसार अलग-अलग)।

• Indemnity Note Goods Shed या Station Master Office से प्राप्त किया जा सकता है।

• Station Master Rs. 1 लाख तक की खेप की डिलीवरी Indemnity Note पर दे सकता है।

• यदि लागत इससे अधिक हो → DCM की अनुमति आवश्यक।

3. Indemnity Note में लिखी जाने वाली जानकारी

1. Booking particulars

2. Description of goods

3. Cost of goods

4. Name और signature of consignee

5. Signature of one surety

6. Signature of two witnesses और उनके विवरण

7. Signature of Station Master, तारीख और Station Seal

4. Indemnity Note के प्रकार (Types)

(a) Stamped Indemnity Note

• Stamp paper पर executed नोट → Stamped Indemnity Note।

• Circumstances:

  1. Goods booked on consignee’s name, लेकिन RR नहीं पेश कर पाए → consignee Indemnity Note पर execute करेगा।

  2. Goods booked to self, लेकिन RR नहीं पेश कर पाए → दो Indemnity Notes की आवश्यकता:

     • एक नोट Consignor द्वारा, Station Master के signature और stamp के साथ Forwarding Station से।

     • दूसरा नोट Consignee द्वारा। दोनों नोटों के बाद ही डिलीवरी।

(b) Unstamped Indemnity Note

• Printed form, Stamp Duty free, Goods Shed / Station Master Office से मुफ्त।

• Accepted Circumstances:
  a. Government Officials के लिए official capacity में booked goods
  b. Registered Co-operative Societies
  c. Law value goods delivery (businessmen के लिए space vacate करने हेतु)

(c) General Indemnity Note

• यदि कोई विशेष व्यापारी नियमित रूप से खेप प्राप्त करता है और RR नियमित नहीं पेश कर सकता, तो उसे General Indemnity Note दिया जाता है।

• प्रक्रिया:

  1. व्यापारी Indemnity Note execute करता है।

  2. Sr. DCM Office से Approval लिया जाता है।

  3. Station पर भेजकर रिकॉर्ड किया जाता है।

• Validity: 3 साल

• Condition: Delivery लेने के 10 दिन के भीतर RR या Stamped Indemnity Note प्रस्तुत करना आवश्यक। नहीं तो सुविधा समाप्त।

• Note: Self booked goods → General Indemnity Note पर डिलीवरी नहीं होगी।
